Terms and Conditions
the Detoxer mobile app, including the end user licence agreement (EULA)
Version 2.0 · Effective from 1 November 2026
This is a translation for information only; under Art. 3.6 the Czech version (Všeobecné obchodní podmínky) is decisive.
Most important notice – read before first use
Detoxer is an app that, once you start a detox, deliberately takes away your internet access for the period you choose. A detox that has started cannot be ended early in the App. This feature cannot be turned off or “bought off”. It is the main purpose of the app, not a defect.
By accepting these terms and by every start of a detox you confirm that you acknowledge and agree that:
- For the entire detox you will not be able to reach any service that needs the internet (the only exception is the default messaging app on Android, see Art. 7.2). This includes in particular internet and mobile banking and payment authorisation (including confirming card payments), e-mail, social networks, chat apps (WhatsApp, Messenger, iMessage, etc.), maps and navigation, taxis and ride sharing, tickets, event tickets and boarding passes on your phone, work apps, cloud storage, smart home and online identity verification (e.g. bank identity, eDoklady, two-factor authentication).
- In the App you cannot end a detox before the time you set yourself has elapsed. The only exception is the remote Guardian (Art. 8.2): a detox can be ended early only with a code issued to you by a trusted person you have chosen. An unpaired Guardian (Android) has no code and cannot end a detox. If you have no Guardian set up, or the Guardian does not give you the code, the detox will run until the end. Count on the detox not being able to be ended early, and do not rely on being able to cancel the protection in an emergency by interfering with your phone’s settings.
- The Operator cannot end a detox, not even at your request. The App has no server through which a detox could be cancelled remotely. Requests for unlocking made by e-mail, by phone or in any other way cannot be granted, not even for payment.
- Emergency calls (112, 150, 155, 158) and ordinary phone calls over the mobile network remain available during a detox. Ordinary SMS via the operator work on Android in the default SMS app and on iPhone only if you have the Messages app set to “Always Allowed” in Screen Time settings. Calls and messages over the internet (e.g. WhatsApp, FaceTime, iMessage, Wi-Fi calling) will not be available.
- You alone are responsible for when and for how long you start a detox. Do not start a detox if during it you will need to pay, travel using navigation, be reachable over the internet, work online or care for a person who depends on your connection.
- During a detox, the ability to uninstall the app or change its settings may also be restricted. Outside a detox the app can be uninstalled normally at any time.
If you do not agree with any of the above, do not use the app and do not start a detox. Detailed provisions are in Art. 5 to 8 of these terms.
Art. 1 Operator and contact details
1.1 The operator of the Detoxer mobile application and the provider of related services is:
Tadeáš Koždoń, a self-employed natural person registered in the Trade Register (Municipal District Office of Prague 6), with registered address at Uralská 689/7, 160 00 Praha 6 – Bubeneč, Company ID (IČO) 23827475, not a VAT payer. Hereinafter the “Operator”.
1.2 Contact details for questions, complaints, withdrawal from the contract and other notices:
- e-mail: info@detoxer.eu
- phone: +420 771 672 239
- address for service: Uralská 689/7, 160 00 Praha 6 – Bubeneč
- web: https://detoxer.eu
1.3 The supervisory authority in the field of consumer protection is the Czech Trade Inspection Authority (www.coi.cz). In the field of personal data protection it is the Office for Personal Data Protection (www.uoou.gov.cz). The trade licensing office is the Municipal District Office of Prague 6.
Art. 2 Definitions
For the purposes of these terms, the following terms have this meaning:
- App – the Detoxer mobile application for the Android and iOS operating systems, including its updates, extensions, widgets and related content.
- User – any natural person who downloads, installs or uses the App. The Parent and the Guardian are also Users to the extent they use the App.
- Consumer – a User who enters into a contract with the Operator outside the scope of their business activity or independent profession.
- Contract – the contract for the supply of digital content and a digital service between the Operator and the User, the content of which is these terms. Its full part, which arises upon purchase of a Subscription under Art. 3.4, is hereinafter referred to as the “Subscription Contract”.
- Store – the App Store operated by Apple or Google Play operated by Google, through which the User obtained the App and through which they pay for the Subscription.
- Detox – a period started by the User during which the App deliberately restricts or completely prevents access to the internet and to services that need the internet on the Device. A Detox may be started once or automatically according to a Plan.
- Detox Period – the time from the start of a Detox until the moment of its end that the User chose before starting it (or that follows from a Plan).
- Plan – a recurring start of a Detox on certain days and at certain times, set by the User.
- Lock – the set of technical measures by which the App, during the Detox Period, prevents early ending of the Detox in the App and, to the extent the platform allows, makes it harder to circumvent it, to uninstall the App or to change its settings.
- VPN profile – a virtual private network configuration that the App creates on the Device with the User’s consent and uses to block internet traffic directly on the Device.
- Guardian – a natural person chosen by the User, to whom the User entrusts the ability to end a Detox early by issuing a Guardian Code.
- Guardian Code – a code that the App displays to the remote Guardian on their phone and with which a Detox can be ended early under Art. 8.2. It differs from the Screen Time passcode that the Guardian can set on the User’s iPhone (Art. 8.2).
- Parental Mode – an App feature that the Parent sets up on the child’s Device and with which the Parent can start or schedule a Detox on the child’s Device and monitor its basic status.
- Parent – the child’s legal guardian or another person who cares for the child and is entitled to decide on the use of the child’s Device.
- Device – the mobile phone or tablet on which the App is installed.
- Subscription – paid access to App features for a monthly or yearly period (or another paid plan), agreed and paid for through the Store.
- Trial Period – the free period at the beginning of a Subscription under Art. 10.3.
- Emergency Functions – emergency calls, ordinary calls and SMS over the operator’s mobile network to the extent under Art. 7.2, which the App does not block.
Art. 3 Conclusion of the contract and acceptance of the terms
3.1 These General Terms and Conditions and Licence Agreement (the “terms”) govern the rights and obligations of the Operator and the User when downloading, installing and using the App and when paying for the Subscription. The end user licence agreement (EULA) in Art. 13 to 15 forms an integral part of them.
3.2 The Contract between the Operator and the User is concluded at the moment when the User, after these terms are displayed in the App, actively confirms that they have read them and agree with them (by ticking a box or pressing a button). Without this confirmation the App cannot be used. The App stores on the Device the date and time of consent and the version of the terms the User agreed to. If the terms change substantially, the App will ask for consent again.
3.3 Before granting permissions for Detox and Lock, the App displays to the User a notice of the consequences of a Detox, in particular that it cannot be ended early in the App and that during it the User will not have access even to their banking app. The User activates the features only if they actively confirm this notice. Before each start of a Detox the App displays the time of its end and a notice that it will not be possible to turn it off earlier. With every manual start of a Detox and every setting or modification of a Plan, the User again confirms that they know and accept the restrictions described in Art. 5 to 8.
3.4 The Subscription Contract is concluded at the moment when the User confirms the purchase of the Subscription in the Store’s interface. The Store’s payment terms are not affected by these terms.
3.5 By confirming the terms, the User declares that:
- they had the opportunity to read the terms before accepting them and to save or print them,
- they are capable of concluding the Contract under Art. 3.7 and 3.8,
- they acknowledge that the main and intended purpose of the App is to prevent them from accessing the internet for the chosen period, even when they urgently need it,
- they acknowledge that they should not start a Detox on a Device on whose internet connection their health or safety, or the health or safety of another person, depends (Art. 7.4).
3.6 The Contract is concluded in the Czech language. If the App is set to another language, the translation of the terms serves for information only and the Czech version is decisive, unless a mandatory legal provision provides otherwise. The Operator does not keep individual contracts. The current and earlier versions of the terms are permanently available at https://detoxer.eu/vop.
3.7 Age. A Subscription may be agreed independently by an adult. A minor may do so only if it is appropriate to their intellectual and volitional maturity (Section 31 of the Civil Code), otherwise with the consent of their legal guardian. A User under 15 may use the App only with the consent and under the supervision of a Parent. In Parental Mode, a Parent may set up the App on the Device of a child of any age, at their own responsibility under Art. 9.
3.8 If the App is used by a minor, the legal guardian is responsible for ensuring that the use of the App, and in particular of Detox, is appropriate with regard to the child’s age, health and needs.
3.9 The User may not use the App if the laws of the country in which they are located prohibit it. The User declares that they are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a terrorist-supporting country, and that they are not listed on any U.S. Government list of prohibited or restricted parties.
Art. 4 What the App is and what it is not
4.1 Detoxer is a tool for voluntary and conscious limitation of the use of the internet and digital services. In it, the User chooses when and for how long they disconnect, and for that time the App technically prevents them from accessing the internet on the Device.
4.2 The App offers in particular the following features (the scope may differ by platform, operating system version and Subscription):
- a one-off start of a Detox for a chosen period, including a 24-hour Detox,
- recurring Detoxes according to Plans,
- the Lock, which prevents early ending of a Detox in the App and during a Detox makes it harder to uninstall the App or change its settings,
- the Guardian feature,
- Parental Mode (on iOS, if available in the given version),
- an overview of time spent offline, Detox history, streaks, levels and badges,
- themes, widgets, reminders and other additional features.
4.3 The App has no server of its own and no user accounts. History, Plans, settings and statistics are stored only on the Device. The Operator therefore has no technical means to remotely end a Detox, cancel the Lock, restore deleted data or transfer data to another Device. Exceptions (Google or iCloud backup in the User’s account, purchases through the Store, Parental Mode via iCloud) are described in the Privacy Policy.
4.4 The App is not a medical device within the meaning of Regulation (EU) 2017/745. It does not serve to diagnose, treat or prevent any disease, disorder or addiction and does not replace the care of a doctor, psychologist, addiction specialist or other professional. Information about time offline, levels, badges and motivational texts are of an informative and motivational nature only. A User with mental health difficulties or an addiction should consult the use of the App with a professional.
4.5 The App is not a parental control tool for content. It does not block specific websites or content, does not record what the User does on the internet and does not protect a child from inappropriate content outside the Detox Period.
4.6 The App is not a security tool or a VPN for anonymous or encrypted browsing. The VPN profile serves exclusively to block traffic on the Device under Art. 6.
4.7 The Operator may continuously update the App, change its appearance, add or modify features, provided this does not substantially reduce the quality of the paid Subscription. The Operator provides the updates necessary to keep the App in conformity with the Contract for the duration of the Subscription (in accordance with Section 2389d of the Civil Code). If the User does not install an update, the Operator is not liable for a defect that arose solely for that reason. If a change to the App would have a more than minor adverse impact on the Consumer, the Operator will inform them of it in advance in the App and the Consumer may terminate the Subscription Contract free of charge within 30 days of the change. The Operator will refund them the proportionate part of the price for the unused period.
4.8 The App works only on supported Devices and operating system versions listed in the Store. Some features, in particular the Lock, the Guardian and Parental Mode, depend on permissions and interfaces provided by Apple and Google. These companies may change or restrict them at any time. The level of protection of the Lock may therefore differ by platform, manufacturer and system version.
Art. 5 Detox and Lock – a started Detox cannot be ended early
5.1 Starting a Detox. Before starting, the User chooses the Detox Period themselves. Before the start, the App shows them until when they will be without the internet. A Detox is started by a conscious action of the User (e.g. by dragging a button), or automatically according to a Plan that the User has set up themselves in advance.
5.2 A Detox cannot be ended early in the App. Once started, a Detox lasts until the end of the chosen Detox Period. The User acknowledges and expressly agrees that:
- there is not and will not be any button, option or payment in the App with which a Detox could be ended earlier,
- a Detox is not ended even by restarting or turning off the Device – after the Device is turned on again, the Detox continues until the end of the Detox Period,
- the Operator will not end a Detox even at the User’s request, not even in an urgent situation and not even for payment. The App has no server or other channel through which this would be technically possible. The Operator will not grant requests for unlocking,
- the only way to end a Detox early in the App is the remote Guardian Code under Art. 8.2, and only if the User set up the remote Guardian before starting the Detox, the Guardian actually issues the code to them and the User enters it within the permitted number of attempts. The Guardian has no obligation to do so.
5.3 Plans. A Detox started according to a Plan has the same effects as a Detox started manually. A Plan must be turned off or modified before the planned Detox begins. The User is responsible for setting their Plans so that their start at the given moment does not cause them harm.
5.4 Lock. During the Detox Period, the App may, with the User’s prior consent, cover other apps (with the exception of Emergency Functions) and, to the extent the platform allows, make it harder in particular to:
- uninstall the App,
- turn off or delete the VPN profile and change network settings related to the Detox,
- force-stop the App and remove permissions the Detox needs,
- change the settings of the App, Plans and the Guardian.
The scope of the Lock differs by platform, manufacturer and system version (see Art. 4.8, 5.5 and 6). Outside the Detox Period the App can be uninstalled normally and all permissions can be removed.
5.5 Turning off protection in the phone settings and circumventing the Lock. On some Devices (in particular on Android) the protection can be cancelled by interfering with the phone’s system settings, for example by turning off a permission, force-stopping the App or disabling the device administrator. This is not an App feature for ending a Detox but a circumvention of the Lock. The Detox is then recorded as interrupted and the Guardian that was set up ceases to apply. The Operator does not guarantee that such an intervention will be possible, quick or safe in a specific situation, and the User must not rely on it as a way to get, for example, into a banking app during a Detox. The User undertakes not to attempt to circumvent the Detox or the Lock. Any harm the User causes themselves by circumventing the Lock (e.g. loss of a streak or settings) is borne by the User alone (Section 2918 of the Civil Code). Circumvention of the Lock is not a defect of the App.
5.6 End of a Detox. When the Detox Period expires, the App restores internet access by itself, even if the Device has been restarted in the meantime. If, exceptionally, the connection is not restored after the end of the Detox Period, the User shall notify the Operator immediately, and the Operator will tell them the restoration procedure without undue delay.
5.7 Early end for technical reasons. A Detox may exceptionally end earlier if it is ended by the operating system, a system update, another app or an outage. In such a case the User may claim the defect under Art. 12.
Art. 6 VPN profile and App permissions
6.1 How blocking works. On Android, the App, with the User’s consent, creates a local VPN profile (the VpnService system interface). For the Detox Period it intercepts the Device’s internet traffic and drops it directly on the Device. On iOS, the App uses the system interface for network extensions (NetworkExtension) and, depending on the version, also the Screen Time interface (Family Controls, Managed Settings, Device Activity).
6.2 Traffic goes nowhere. The User’s internet traffic is not forwarded through the VPN profile to any server of the Operator or of a third party. The Operator does not see it, does not record it, does not store it and does not pass it on to anyone. The App’s VPN profile does not serve to anonymise, encrypt or change the User’s location.
6.3 Permissions. Depending on the platform and feature, the App may ask in particular for the following permissions:
| Permission | Platform | Purpose |
|---|---|---|
| VPN (VpnService / NetworkExtension) | Android, iOS | blocking the internet during a Detox |
| Accessibility Service (AccessibilityService) | Android | Lock: during a Detox, recognise which app is open and cover it if it is locked |
| Device administrator (Device Admin) | Android | Lock: make it harder to uninstall the App during a Detox |
| Screen Time (Family Controls) | iOS | Lock, Guardian and Parental Mode |
| Notifications | Android, iOS | end of a Detox, Plan reminders, end of the Trial Period |
| Start after restart, running in the background, battery optimisation exemption | Android | continuation and reliable ending of a Detox |
| iCloud | iOS | synchronisation of some settings in your iCloud account; Parental Mode under Art. 9 (if available) |
| Usage access – optional | Android | display of actual screen time in the Overview and the weekly report |
| Exact alarms, killing background processes | Android | starting and ending a Detox exactly at the set time, closing locked apps |
6.4 The App asks for each permission separately and explains what it needs it for. Granting a permission is voluntary. Without it, however, the relevant feature may not work. The Accessibility Service and the device administrator are used exclusively for the Lock and can be turned off in the phone settings (Art. 5.5). The Accessibility Service only determines which app is currently open so that the App can cover it during a Detox. Through them the App does not read screen content, messages or entered text and sends nothing. On the Device it only remembers the aggregate number of attempts to open a locked app (including its name) over the last 30 days. The App uses usage access only to display the screen time measured by Android and does not send this information anywhere.
6.5 Coexistence with other apps. Only one VPN profile can be active on a Device at a time. Starting a Detox may disconnect another VPN (e.g. a corporate one) or stop private DNS, another provider’s parental control or corporate device management (MDM) from working. Conversely, corporate rules, device management, other apps or battery saving may restrict or prevent the App from working. The User shall verify themselves whether they may use the App on the Device (e.g. a work Device).
6.6 Details on data processing are contained in the Privacy Policy at https://detoxer.eu/soukromi.
Art. 7 What does not work during a Detox and what the User is responsible for
7.1 The User expressly acknowledges that for the entire Detox Period they will not have access to the internet and that in particular the following will not work:
- internet and mobile banking, confirming payments and logging in to the banking app, payments in apps and e-shops and online transfers. Payments by phone and watch at a terminal (Apple Pay, Google Pay) may not work,
- identity verification and logging in over the internet: bank identity, eDoklady, Citizen Portal, authenticator apps and two-factor authentication via an app,
- e-mail, chat and communication apps (WhatsApp, Messenger, Signal, Telegram, iMessage, etc.) with the exception of the default messaging app on Android under Art. 7.2, social networks and calls over the internet (FaceTime, WhatsApp, Wi-Fi calling),
- maps, navigation and location sharing, including location sharing with family and features for finding the Device,
- taxis, ride sharing, online tickets, event tickets, boarding passes and check-in, reservations and delivery services,
- work and school apps and services, apps for on-call duty and services requiring online availability, cloud storage and backups,
- smart home apps, smart locks, alarms, cameras and vehicle apps,
- health apps that need the internet – for example sharing glucose or heart activity readings with a doctor or loved ones, telemedicine, emergency buttons and fall detection over the internet,
- receiving notifications from internet services. Anyone trying to call or write to the User over the internet will not learn about the Detox,
- features of the App itself that need the internet (e.g. Subscription management).
7.2 What works. The App does not block calls over the operator’s mobile network or emergency calls (112, 150, 155, 158). Ordinary SMS via the operator work on Android in the app set as the default for SMS. MMS may not work. On iPhone they work only if the User has the Messages app set to “Always Allowed” in Screen Time settings (from iOS 27, App & Website Activity must also be turned on). The availability of calls and SMS depends on the signal and services of the mobile operator, which the Operator cannot influence. On Android, the default messaging app (e.g. Google Messages) has internet access during a Detox, so RCS chat messages may also work in it. Other apps do not have internet access. Messages over the internet in other apps (iMessage, WhatsApp, Messenger, etc.) will not arrive during a Detox. In a place without mobile network signal, where the User could only call over Wi-Fi, calling may be unavailable during a Detox – do not start a Detox in such a place.
7.3 The restrictions listed are the intended and desired result of the App, not its defect. The User accepts them by confirming these terms and again with every manual start of a Detox and every setting or modification of a Plan.
7.4 User’s responsibility. The User is responsible for starting a Detox only at a time and place where the restriction of the internet will not cause them harm or endanger them or other persons. In particular, the User will not start a Detox,
- if during the Detox Period they expect a payment, a payment confirmation or another urgent transaction,
- if they are driving, travelling to an unfamiliar place or relying on navigation or an online ticket,
- if they are on call or are obliged to be available online,
- if they care for a child, a sick or otherwise dependent person who needs to contact them over the internet,
- if their health or safety depends on an app that needs the internet.
7.5 The User shall ensure themselves that those who need to contact them (family, employer, school) learn of their unavailability. The User is responsible for the consequences of their unavailability towards third parties.
7.6 The restriction of internet access during a Detox is the performance the User agreed to, not a breach of the Contract. The Operator therefore does not compensate harm that arises to the User or a third party solely because the Detox worked as described and as started by the User (e.g. a missed payment, a contractual penalty, a missed connection, a lost order or a missed message). This does not affect the Operator’s liability for breach of its obligations or Art. 16.4.
Art. 8 Guardian
8.1 The Guardian is a voluntary feature for situations where the User knows in advance that they might want to end a Detox early and wants to entrust that option to someone else. The User sets up the Guardian before starting a Detox. While a Detox is running, the Guardian cannot be added, removed or changed.
8.2 Only a person with full legal capacity whom the User chooses themselves and who agrees with the role can be a Guardian. Depending on the platform, the App offers the following forms:
- Remote Guardian (Android and iOS, also between them): the User sends the Guardian an invitation by SMS. The Guardian opens it in the App on their phone. During a Detox the User can send them a request by SMS or call them, and the Guardian’s App displays the Guardian Code to them. The number of attempts to enter the code is limited.
- Fixed passcode protection (iOS only): the Guardian sets their own passcode in the system Screen Time settings. Without it, the settings cannot be changed and the App cannot be uninstalled during a Detox.
- Unpaired Guardian (Android): the Guardian has no code and the App does not lock anything further. It is a person to whom the User promises not to interrupt the Detox and whom they can contact during the Detox.
The specific procedure is described in the App.
8.3 The Operator does not know, see or store the Guardian Code and cannot restore, issue or bypass it. If the Guardian does not issue the code, cannot be reached, forgets or loses the code, the Detox will run until the end of the Detox Period. Restoring a forgotten system Screen Time passcode is governed by Apple’s rules, not the Operator’s.
8.4 The Guardian is not a representative or an assistant of the Operator. They decide on issuing the code entirely on their own and at their own discretion and have no obligation to issue it. The User acknowledges that the Guardian may not issue the code even in a situation the User considers urgent (e.g. when they need to get into a banking app). The Operator is not liable for the conduct, inaction or decisions of the Guardian.
8.5 The User chooses the Guardian with regard to them being reachable by call or SMS during the Detox Period. The User alone is responsible for the Guardian being clearly informed of their role and for using the Guardian’s phone number with their consent.
8.6 Outside the Detox Period the User may remove the Guardian in the App. If the Guardian is set up via the Device’s system passcode, this passcode may also be needed to remove them.
8.7 SMS and calls. Invitations, requests and codes are sent by ordinary SMS or communicated by a call via the mobile operator of the User and the Guardian. The User and the Guardian pay for these SMS and calls to their operator according to their tariffs. The Operator does not charge for them. During a Detox the code must be sent by classic SMS or communicated by a call: iMessage does not arrive without the internet and RCS chat works only in the default messaging app on Android. On iPhone, the User can open SMS during a Detox only with the setting under Art. 7.2.
Art. 9 Parental Mode
9.1 Parental Mode is an iOS feature that the Operator may make available in some version of the App. This article applies if it is available in the version used. The Parent sets it up on the child’s Device. Depending on the version of the App and the system, the Parent can start and schedule a Detox on the child’s Device and see its basic status: when the Device was last active, until when it is locked, until when it has internet and whether the necessary permissions have been granted. Setup may require Family Sharing and the Screen Time permission under Apple’s rules.
9.2 The status of the child’s Device is transmitted via iCloud (Apple’s CloudKit service). The child’s name, location, communication content, browsing history and Device content are not transmitted. Details are set out in the Privacy Policy.
9.3 Parental Mode does not monitor the child’s content or location and does not protect them from inappropriate content. It is a tool with which the Parent takes away the child’s internet access for a certain period.
9.4 The Parent declares that they are the child’s legal guardian or are authorised to set up Parental Mode, and is responsible for:
- using Parental Mode in the child’s interest and appropriately to their age, health and needs (school, transport, clubs, health apps),
- the child being reachable by call or SMS during a Detox and knowing how to call 112 in an emergency,
- explaining to the child, appropriately, what Parental Mode does and what data about the Device is shown to the Parent,
- taking into account that during a Detox the child will not be able to reach any service that needs the internet (Art. 7), including navigation, online tickets, school apps and communication with the family over the internet.
9.5 A Detox started in Parental Mode cannot be ended early by the child. The Operator will not end it even at the request of the child or the Parent. It can be ended only in the way the App offers to the Parent.
9.6 Prohibition of misuse. No one may set up the App, the Lock, the Guardian or Parental Mode on the Device of another adult without their knowledge and consent, or use them to control, monitor or restrict another person against their will. The person who committed such conduct is solely responsible for it. If misuse is discovered, the Operator may proceed under Art. 20.3.
Art. 10 Subscription, prices and trial period
10.1 Free part. The App can be downloaded free of charge. The Operator may allow some features to be tried without a Subscription (e.g. the first Detox). The full features of the App are available only with an active Subscription.
10.2 Plans and prices. The current plans are:
| Plan | Price in CZK | Price in EUR | Renewal |
|---|---|---|---|
| Monthly (detoxer_monthly) | CZK 99 | €3.99 | automatically every month |
| Yearly (detoxer_yearly) | CZK 999 | €39.99 | automatically every year |
Prices are final, including VAT, which in the EU is remitted by the Store. The Operator is not a VAT payer. In other countries and currencies, the price that the Store displays to the User before purchase applies. The price displayed in the Store at the moment of purchase is always decisive. The Operator may also offer other plans. It will add their terms to these terms before introducing them.
10.3 Trial Period. A new User may be entitled to a 7-day free Trial Period if the Store offers it for the given plan. The Trial Period can be used only once per Store account and only once per plan, unless the Store provides otherwise. If the User does not cancel the Subscription before the end of the Trial Period (for the App Store no later than 24 hours before its end), the Store will automatically charge them the price of the chosen plan after it ends and the Subscription continues to renew automatically. The App may notify the User of the approaching end of the Trial Period. However, the notification is only an additional service and its non-delivery has no effect on the payment.
10.4 Automatic renewal. The Subscription renews automatically for a further period of the same length and the Store charges for it from the payment method set in the User’s account until the User cancels the Subscription. For the App Store the Subscription must be cancelled no later than 24 hours before the end of the current period. For Google Play at any time before the renewal date.
10.5 Cancelling the Subscription. The Subscription is cancelled in the subscription settings in the Store (App Store: Settings → [your name] → Subscriptions; Google Play: Profile → Payments & subscriptions → Subscriptions). The App links to this management. Merely uninstalling the App does not cancel the Subscription. After cancellation, the Subscription remains active until the end of the period already paid. Cancellation during the Trial Period is governed by the Store’s rules. For the App Store, access may end immediately.
10.6 Payments and refunds. Payments are received and processed exclusively by the Store. The Operator has no access to the User’s payment details. Payment for a period already started is not refunded, except in cases under Art. 11 and 12 and mandatory legal provisions. Refunds for purchases via the App Store are decided and made by Apple. The request is submitted at reportaproblem.apple.com. For Google Play, a refund can be requested through Google Play within 48 hours of purchase, thereafter from the Operator. The Operator cooperates with the User in handling it.
10.7 Price change. The Operator may change the price of the Subscription. The Store or the Operator will inform the User of a price increase in advance according to the Store’s rules, at least 30 days before the change takes effect. If the Store requires the User’s consent for the given increase and the User does not give it, the Subscription will not renew on the renewal date. A User who disagrees with the increase may cancel the Subscription following the procedure under Art. 10.5. A price change does not apply to a period already paid.
10.8 Discount and promo codes. The Operator may offer discounts, promo codes and offers for new or existing Users. A code can be redeemed only in the Store for which it was issued and under the conditions stated with the code and the Store’s rules. A code is non-transferable, cannot be exchanged for money and one User may redeem it only once, unless stated otherwise. Obtaining a code by fraud or reselling it entitles the Operator to refuse the offer.
10.9 Transfer between devices. The Subscription is tied to the User’s Store account. On a new Device with the same account it can be restored with the “Restore purchases” option. A Subscription purchased in the App Store cannot be transferred to Google Play and vice versa. Sharing via Apple Family Sharing is possible only if allowed for the plan.
10.10 End of the Subscription during a Detox. If the Subscription ends or fails to renew during the Detox Period, a Detox already running will run until the end. New Detoxes and Plans may not be possible to start without a Subscription.
10.11 Non-payment. If the Store does not collect the payment, the Subscription may continue for the duration of the Store’s grace period and then be paused or end.
Art. 11 Withdrawal from the contract (for Consumers)
11.1 A Consumer may withdraw from a Subscription Contract concluded at a distance without giving any reason within 14 days from the day of its conclusion under Art. 3.4 (Section 1829 of the Civil Code).
11.2 Trial Period. By cancelling the Subscription during the Trial Period under Art. 10.5, no payment arises for the Consumer. Withdrawal during this time is free of charge.
11.3 Period and Trial Period. The Subscription Contract is concluded by confirming the purchase in the Store, even if it begins with a Trial Period. The 14-day period runs from that moment. If the Consumer withdraws from the Contract within this period after the first payment, the Operator will refund them the price paid following the procedure under Art. 11.5. After the period has expired, the Subscription can be cancelled at any time with effect at the end of the paid period under Art. 10.5.
11.4 How to withdraw. The Consumer may withdraw:
- by e-mail to info@detoxer.eu,
- by letter to the Operator’s address under Art. 1,
- by any other unambiguous statement, for example using the model form in Annex 1,
- from 1 January 2027 also via the “Odstoupit od smlouvy” (Withdraw from the contract) button at https://detoxer.eu/odstoupeni (the link is also in the App), which is available for the entire withdrawal period (Act No. 159/2026 Coll.). The button leads to a form. The withdrawal is sent with a second button, “Potvrdit odstoupení od smlouvy” (Confirm withdrawal from the contract).
For quick handling we recommend stating your name, the Store in which the purchase was made, the date of purchase, or the order number from the Store’s confirmation, and an e-mail for sending the confirmation. The Operator will confirm receipt of the withdrawal in text form without delay. To meet the deadline, it is sufficient to send the withdrawal before it expires.
11.5 Refund. The Operator will refund the Consumer the funds received within 14 days of withdrawal. For Google Play, it refunds the payment via Google Play. For the App Store, payments are refunded by Apple. The Consumer requests the refund at reportaproblem.apple.com and the Operator will help them with it. If Apple does not refund the payment within 14 days of withdrawal, the Operator will refund it to the Consumer directly by bank transfer to the account the Consumer provides. The Consumer will not incur any additional costs as a result.
11.6 Upon withdrawal, the Subscription Contract terminates. The Operator cannot cancel a Subscription in the App Store itself, and therefore the Consumer shall at the same time cancel automatic renewal following the procedure under Art. 10.5. For Google Play, the Operator cancels the Subscription. If the Store nevertheless charges a further payment after withdrawal, the Operator will refund it to the Consumer following the procedure under Art. 11.5. A Detox already running will run until the end of the Detox Period.
Art. 12 Defects and complaints
12.1 The Operator is responsible for the App being in conformity with the Contract and free of defects for the duration of the Subscription (Section 2389c and Section 2389i of the Civil Code). The Operator provides the free part of the App without entitlement to remuneration. For a Consumer, this does not exclude their statutory rights.
12.2 The following in particular are not a defect of the App:
- restriction or complete prevention of access to the internet and to services under Art. 7 during the Detox Period,
- the impossibility of ending a Detox early, uninstalling the App or changing its settings during the Detox Period,
- the Guardian not issuing the Guardian Code or not being reachable,
- the start of a Detox according to a Plan that the User set up,
- restriction of features caused by the operating system, its update, the Device manufacturer, Device settings, device management (MDM), another VPN or another app, if the Operator could not remove it by a reasonable update of the App,
- failure to grant or removal of permissions under Art. 6,
- circumvention of the Lock by intervention of the User or a third party,
- a defect that arose because the User did not install an available update, or uses an unsupported Device or system,
- an outage of the Store, the iCloud service or the operator’s mobile network.
12.3 How to make a complaint. The User shall report the defect without undue delay after discovering it by e-mail to info@detoxer.eu. They shall state a description of the defect, the Device type, the system and App version and, if possible, attach screenshots. The Operator will confirm receipt of the complaint and handle it, including removal of the defect, no later than 30 days from when it was made, unless the parties agree on a longer period.
12.4 Rights arising from a defect. The Consumer has the right to have the App brought into conformity with the Contract free of charge within a reasonable time. If this is not possible, the Operator does not remove the defect within a reasonable time, the defect recurs or it is a material breach of the Contract, the Consumer has the right to a reasonable discount or may withdraw from the Contract (Section 2389m of the Civil Code). It is not possible to withdraw from the Contract for a minor defect. The Operator refunds money following the procedure under Art. 11.5.
12.5 A User who is not a Consumer may claim a defect only within 3 months of its occurrence. For the scope of liability, Art. 16.5 applies.
Art. 13 Licence to the App (EULA)
13.1 The Operator grants the User a non-exclusive and non-transferable licence without territorial restriction, which the Operator may terminate only under Art. 20.3, to use the App for personal and non-commercial purposes, on Devices that the User owns or controls, within the scope of the usage rules of the relevant Store (for the App Store within the scope of the Usage Rules under the Apple Media Services Terms and Conditions, including Family Sharing, if permitted). The licence is granted for the duration of the Contract, and for paid features for the duration of the Subscription.
13.2 The licence is free of charge to the extent of the free part of the App and for consideration to the extent of the Subscription. The User is not obliged to use the licence.
13.3 The User may not (except where expressly permitted by a mandatory legal provision):
- copy, modify, translate, decompile, reverse engineer or otherwise examine the App’s source code,
- create derivative works or incorporate the App or its parts into other software,
- rent, lend, sell, sublicense or otherwise provide the App to third parties,
- remove or alter copyright and other rights notices,
- circumvent technical measures, the licence check, the Subscription or the Lock,
- use the App in breach of legal regulations or these terms.
13.4 The licence terminates upon termination of the Contract, upon uninstalling the App from all of the User’s Devices, or if the Operator terminates it for a material breach of the terms under Art. 20.
13.5 The App may contain third-party components (e.g. the Android Jetpack and Google Play Billing libraries), which are governed by their own licences. Their list and licences are provided in the App or on the Operator’s website.
13.6 The User is obliged to comply with the third-party terms that apply to the use of the App, in particular the terms of the Store, the iCloud service and the contract with their mobile operator.
Art. 14 Intellectual property
14.1 The App, its source code, graphics, illustrations, texts, sounds, arrangement and databases are protected by copyright and other intellectual property rights. The rights to them are exercised by the Operator as their owner or on the basis of a licence. The User acquires no rights other than the licence under Art. 13.
14.2 The name Detoxer, the logo and other designations of the App are designations of the Operator. The User may not use them without the Operator’s prior written consent, in particular not for their own products, services, domains or social media accounts.
14.3 If the User sends the Operator suggestions, ideas or comments on the App, the Operator may use them free of charge and without restriction. The User is not entitled to any remuneration for a suggestion.
14.4 If a third party claims that the App or its use infringes its intellectual property rights, the Operator, not Apple or Google, is responsible for the investigation, defence and settlement of such a claim.
Art. 15 Prohibited conduct
15.1 The User undertakes that they:
- will not use the App to restrict, monitor or control another person without their knowledge and consent (except for Parental Mode under Art. 9),
- will not attempt to disrupt or circumvent the Lock, the Subscription, the licence check or other technical measures of the App, nor assist in doing so or distribute instructions for circumvention,
- will not distribute the App in a modified form or outside the official Stores,
- will not abuse the Trial Period and discount codes, in particular by creating multiple Store accounts,
- will not interfere with the iCloud service and the Parental Mode data of other Users or attempt to gain access to them,
- will not use the App for conduct that is contrary to legal regulations or good morals.
15.2 In the event of a breach of this article, the Operator may proceed under Art. 20 and claim compensation for damage.
Art. 16 Liability
16.1 The App is provided in the form in which it is (“as is”), with the features described in these terms and in the Store. The Operator does not guarantee that the App will work continuously, without errors and on all Devices, nor that it will help the User achieve a specific result (less time on the phone, better sleep, concentration, etc.). This does not affect the Consumer’s rights arising from defective performance.
16.2 The User acknowledges that they alone decide on the start, length and timing of a Detox (in Parental Mode, the Parent), after prior repeated and clear notice of its consequences (the introductory notice, Art. 3.3, 5, 7, 8 and 9 and notices in the App). Harm arising from the User not having access to the internet during a Detox arises from a circumstance on the User’s side of which they were informed in advance and to which they expressly agreed (Section 2918 of the Civil Code).
16.3 Towards a Consumer, Art. 7.6 and 16.2 apply. Towards a User who is not a Consumer, the Operator is not liable in particular for:
- damage or other harm caused by the restriction of internet access during a Detox (Art. 7.6),
- lost profit, loss of an order, contractual penalties, late payment charges and other indirect and consequential damage,
- loss of data stored only on the Device (e.g. after uninstallation, replacement of the Device or a factory reset),
- the conduct or inaction of the Guardian, the Parent, the Store, Apple, the mobile operator or other third parties,
- restrictions caused by the operating system, the Device manufacturer, other apps or device management,
- the consequences of the User’s attempt to circumvent the Lock.
16.4 The limitations of liability in this article or elsewhere in the terms do not apply to harm to natural human rights (in particular to life and health), to damage caused intentionally or through gross negligence, to liability for damage caused by a defective product under special legal regulations (including the regulations implementing Directive (EU) 2024/2853, under which software is also a product) and to other cases where liability cannot be excluded or limited in advance under Section 2898 of the Civil Code or consumer protection regulations. The Consumer’s statutory rights arising from defective performance remain unaffected.
16.5 Towards a User who is not a Consumer, the Operator’s total liability is limited to the amount the User paid the Operator for the Subscription in the 12 months before the damage arose. This does not apply in cases under Art. 16.4.
16.6 The User is liable to the Operator for damage they cause it by breaching these terms, in particular by misusing the App under Art. 9.6 and 15.
Art. 17 Force majeure
The Operator is not liable for failure to fulfil an obligation caused by an extraordinary, unforeseeable and insurmountable obstacle arising independently of its will (Section 2913(2) of the Civil Code). This includes in particular natural disasters, war, large-scale internet or power outages, a cyber attack, intervention by a public authority and an outage or change of the rules of the Store, the iCloud service or operating systems. The Operator will inform the User of such an obstacle without undue delay, if possible, and will make reasonable efforts to restore the App’s features.
Art. 18 Personal data
18.1 The App has no user accounts or server of its own and the Operator does not use analytics or advertising tools in the App. Data about Detoxes, Plans and settings remain on the Device. Purchase data are processed by the Store. In Parental Mode (if available), the status of the child’s Device is transmitted via iCloud.
18.2 Detailed information on the processing of personal data in the App and on the detoxer.eu website is contained in the Privacy Policy at https://detoxer.eu/soukromi.
Art. 19 Changes to the terms
19.1 The Operator may reasonably change these terms, in particular due to a change in the App’s features, legal regulations, the Store’s rules or prices. The Operator will announce a change in the App and at https://detoxer.eu/vop at least 30 days before it takes effect. A change required by a legal regulation or by security may be made by the Operator even with a shorter notice period.
19.2 Before they take effect, the Operator will submit substantial changes to the App to the User for approval (Art. 3.2). If the User rejects the change, they may terminate the Contract: they cancel the Subscription (if active) with effect from the next renewal date and uninstall the App outside the Detox Period. Other changes apply from their effective date unless the User rejects them by then by terminating the Contract. A change does not apply to a Detox that is already running.
19.3 A change may not, without the User’s consent, reduce the scope of a Subscription already paid for.
Art. 20 Duration and termination of the Contract
20.1 The Contract is concluded for an indefinite period. The Subscription lasts for the paid period and renews automatically under Art. 10.
20.2 The User may terminate the Contract at any time by cancelling the Subscription under Art. 10.5 (with effect at the end of the paid period) and uninstalling the App outside the Detox Period.
20.3 If the User materially breaches these terms, in particular Art. 9.6 or 15, the Operator may withdraw from the Contract and terminate the licence. If possible, it will first call on the User to remedy the situation. For Google Play, it cancels the Subscription itself. For the App Store, it calls on the User to cancel the Subscription and refunds the price paid for the period after the termination of the Contract.
20.4 Discontinuation of the App. The Operator may discontinue the operation of the App. It will announce this to Users in the App and on the website at least 60 days in advance and will ensure that the Subscription no longer renews. It will refund the proportionate part of the price for the paid and unused period.
20.5 Assignment of the Contract. The User agrees that the Operator may assign the Contract to a third party, in particular to a company that the Operator establishes or in which it will do business, or to an acquirer of the App. The assignment is effective towards the User upon notification in the App or on the website (Section 1895 of the Civil Code). The User’s rights are not curtailed by this. The User may not assign the Contract without the Operator’s consent.
Art. 21 Governing law and dispute resolution
21.1 The Contract is governed by the law of the Czech Republic, in particular the Civil Code (Act No. 89/2012 Coll.) and Act No. 634/1992 Coll., on Consumer Protection. If the User is a Consumer with habitual residence in another country, this choice does not deprive them of the protection afforded to them by the mandatory provisions of the country of their residence (Art. 6 of the Rome I Regulation).
21.2 The Operator tries to resolve complaints and disputes by agreement. The User may contact info@detoxer.eu.
21.3 Out-of-court resolution of consumer disputes. The Consumer has the right to out-of-court resolution of a dispute. The competent body is the Czech Trade Inspection Authority, Štěpánská 15, 120 00 Praha 2, https://adr.coi.cz. A Consumer from Slovakia may also contact the Slovak Trade Inspection or another alternative dispute resolution body registered in Slovakia.
21.4 Disputes that cannot be resolved by agreement are decided by the courts of the Czech Republic having subject-matter and local jurisdiction. A Consumer resident in another EU country may always also sue before a court of the country of their residence and may be sued only there.
Art. 22 Special provisions for the App from the App Store and Google Play
22.1 These terms are concluded only between the Operator and the User, not with Apple or Google. The Operator alone is responsible for the App and its content. The terms may not conflict with the Apple Media Services Terms and Conditions or the Google Play Terms of Service. In the event of a conflict with the Store’s usage rules (for the App Store, the Usage Rules), those rules take precedence. The Consumer’s rights under Art. 11 and 12 are not affected by this.
22.2 Maintenance and support of the App are provided exclusively by the Operator at the contact details under Art. 1. Neither Apple nor Google has any obligation to provide any maintenance or support for the App.
22.3 If the App is not in conformity with the Contract (is defective), the User may notify Apple. In such a case Apple will refund them the purchase price of the App, if it was paid. To the extent permitted by law, Apple has no other warranty obligations and the Operator is responsible for all other claims, losses, damages and costs.
22.4 The Operator, not Apple, is responsible for claims of the User or third parties relating to the App. These are in particular product liability claims, claims of non-compliance with legal or regulatory requirements and claims under consumer protection and privacy regulations.
22.5 Apple and its subsidiaries are third-party beneficiaries of these terms. Upon their acceptance by the User, Apple has the right to enforce them against the User.
Art. 23 Final provisions
23.1 If any provision of the terms is invalid or ineffective, the other provisions remain in force. Instead of the invalid provision, the provision that comes closest to its meaning and is in accordance with the law shall apply.
23.2 The Operator and the User communicate electronically, in particular by e-mail and through the App. An e-mail is also considered written form.
23.3 These terms in version 2.0 take effect on 1 November 2026 and replace the previous version of the terms (version 1.1).
